ADDENDUM TO TENANCY LEASE AGREEMENT
1.Rent to be paid by e-transfer on or before first day of each month.
2.Late payment: $25.00 is added to any late rental payment.
3.Electronics Deposits: is required such as (but not limited to) remote controls, doorbell camera (doorbell camera $15/mo extra) and router and/or cable box. The passwords for any devices shall be changed and/or relinquished by tenant upon ending a tenancy.
4.Ending Tenancy: A tenant can terminate a lease at any time with one full calendar month written notice to the landlord. The apartment is to be left as described in the original Condition Inspection Report in order to receive the full damage and equipment deposits. Refer to RTB rules on ENDING A TENANCY.
5.Inspections: RTB allows monthly inspections to be made with proper notice. Full inspections will be made (at minimum) twice a year to do repairs, clean drains, inspect cleanliness, window tracks, appliances, Nicotine testing, AC maintenance, fire suppression, and smoke/CO2 detectors. Any damage to townhouse will be resolved at this time. Refer to RTB rules on LANDLORD’S ACCESS.
6.Overnight guests: At a maximum of eight nights per month permitted. Contact landlord for amendment to increase the length of stay for guests and arrange parking. Refer to RTB “Guests During Tenancies” rules on overnight guests. Guests must be accompanied by tenants at all times in common areas during their visit. Guest parking is on the street.
7.Garbage and Recycling: Garbage and recycling bins are provided. Any items too big to fit in the bin must be disposed of by the tenant. Do NOT leave oversized items beside bins.
8.Content Insurance: The landlord’s insurance does not cover any tenant’s contents. We highly recommended that the tenants purchase this insurance for the duration of this lease. Any damage to other suites’ contents caused by a tenant’s negligence can be covered this way. (example water: a wall hanging through a pipe or a tap left running that causes damage to another suites’ contents)
9.Quiet Time: 10:00 pm – 7:00 am is quiet time – Refer to the RTB’s description of QUIET ENJOYMENT and THE DISTRICT OF SUMMERLAND BYLAWS
10.Outside Responsibilities: Entrance and balconies are not to be used for storage and are to be kept tidy at all times including removal of snow from your stoop. (small shovels and salt are provided upon request) Charcoal briquettes/open flame bbqs are not allowed on the property as per property insurance policy. Electric and infrared BBQs are okay Porches and balconies must be cleared of all items from November 1st to March 31st, refer to THE DISTRICT OF SUMMERLAND GOOD NEIGHBOUR BYLAW
11.Vehicles: -One Parking Stall per townhome-A second stall can be rented when available (second stall $25/mo extra)-Visitor parking spots Maximum 4 hours, no overnight. Street parking is available.-All vehicles on the property must have valid proof of insurance and license plates.-Leaks from vehicles must be cleaned up immediately by owner.-No mechanical work can be performed on a vehicle on this property. Summerland bylaw on Vehicle Storage applies.-No derelict vehicles on this property.
12.Plants: Potted plants must be on a plant caddie with wheels if kept on inside floor, balcony or porch.
13.Wall Hangings: Contact the landlord for location of studs. (Brand name: Command Centre is approved) There are specific reinforced areas for mounting TVs. Failure to contact landlord may result in damaging hidden pipes and electrical in walls and ceiling. This damage will be repaired at tenants’ cost immediatley. Ceiling hooks, holes, nails and any stickers (including bathtub non slip stickers) are not permitted anywhere in the townhouse. Contact the landlord before mounting or hanging items weighing over 1.5kg (or 3lbs.)
14.No Pets: There are no pets allowed. If you acquire a pet under any circumstances, your landlord has the right to evict you. If you’re evicted, your landlord may sue you for the remainder of your lease payment. Refer to RTB rules on PETS.
15.Fruit trees are for all tenants’ use. Please do not pick fruit you personally cannot use.
17a.NO SMOKING RULE. Inhalable combustibles are not to be consumed on site. Refer to the Residential Tenancy Branch’s (“RTB”) description of QUIET ENJOYMENT. See detailed no smoking rules below
17b. DETAILED NO SMOKING RULES The following additional provisions shall be fully applicable to the Tenant and made part thereof as though included within the Lease itself. PURPOSE: Tenant acknowledges the following: smoking increases the risk of fire; smoking is likely to damage the townhome; second hand and third hand smoke is likely to drift from one apartment to another; and exposure to second hand and third hand smoke can cause negative health outcomes. The NO SMOKING RULE is intended to protect the health of our residents and guests. It also preserves the integrity of the building. DEFINITIONS: The term smoking shall include the inhaling, exhaling, burning, or carrying of any lighted or heated cigarette, cigar, pipe, hookah, marijuana (including medical marijuana), or any other product or substance that is intended for smoking. “Smoking” also includes the use of an electronic smoking device that creates a vapor, including e-cigarettes, e-cigars, e-pipes, e-hookahs, vape pens, etc. NO SMOKING RULE: No Tenant shall smoke, nor permit anyone to smoke, in the Tenant’s townhome. Smoking is also be prohibited throughout the entire residence, including but not limited to, balconies and patios, stairways, parking areas and storage areas, etc. The policy will apply to tenants, as well as guests, maintenance personnel, service persons, and anyone entering the property. Nicotine testing WILL be done and breach of this rule gives the landlord the right to evict you. COMPLIANCE: Landlord shall take reasonable steps to ensure compliance with the terms and provisions of this Addendum. All tenants shall inform their guests of the NO SMOKING RULE. Tenant shall promptly give Landlord notice of any incident of smoking or migrating second hand and third hand smoke. THIRD-PARTY BENEFICIARIES: Tenants agree that other tenants at the complex are the third-party beneficiaries of these No Smoking Rules and, accordingly, a tenant has the right to sue another tenant for an injunction to prohibit smoking or for damages. Any exercise of these rights shall not create a presumption that the Landlord breached these rules. DISCLAIMER: Tenant acknowledges the following: a) that the adoption and/or enforcement of the no smoking rule shall not make the Landlord a guarantor of Tenant’s health or of the smoke-free condition of the Tenant’s apartment and the common areas; b) the adoption and/or enforcement of the no smoking rule shall not, in any way, change the warranty of habitability, the covenant of quiet enjoyment, or other duty of care owed to the Tenant; and c) that Landlord’s ability to police, monitor, or enforce the no smoking rule is dependent in significant part on compliance by the Tenant and Tenant’s guests. Landlord specifically disclaims any implied or express warranties that the building(s), common areas, or Tenant’s premises will have any higher or improved air quality standards than any other rental property. Landlord cannot and does not warranty or promise that the rental premises or common areas will be free from second hand and third hand smoke.
IMPORTANT: EFFECT OF BREACH AND RIGHT TO TERMINATE LEASE: A breach of this Lease Addendum shall give each party all the rights contained herein, as well as the rights in the Lease. A material breach of this Lease Addendum shall be considered a material breach of the Lease, therefore grounds for enforcement actions, including eviction, by the Landlord. Tenant acknowledges that a breach of this Lease Addendum shall render Tenant liable to Landlord for the costs of repair to Tenant’s apartment unit due to damage from smoke, odors or residue.
